§ 1

General provisions

This Privacy Policy provides information related to the protection and processing of personal data collected by the Administrator in connection with the use of the Application. This Privacy Policy takes into account the requirements that arise from the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95 / 46 EC (General Data Protection Regulation), hereinafter referred to as “GDPR”. The Application Privacy Policy is made available to Users by the Administrator in connection with the Users’ downloading of the Loyalty Club Application from the Google Play or AppStore online store. When registering in the Application, the User agrees to the processing of his personal data in accordance with the Application Privacy Policy and to sending him profiled marketing information, in accordance with art. 10 sec. 2 of the Act of July 18, 2002 on the provision of electronic services, art. 172 sec. 1 of the Act of July 16, 2004 – Telecommunications Law and GDPR. The above applies to the Administrator and the commercial partner sending the User commercial and marketing information in the Application itself, via the e-mail address provided in the Application and by means of push notifications.

§ 2

Administrator

The administrator of Users’ personal data collected in connection with the use of the Application is QRtag Sp. z o.o. with headquarters in Poznań at ul. Głogowska 70/18, 60-740 Poznań, registered in the Register of Entrepreneurs kept by the District Court Poznań – Nowe Miasto and Wilda in Poznań, 8th Commercial Division of the National Court Register, under KRS number: 0000595589, NIP: 7831735647, REGON: 363401597, share capital of PLN 60,700 , e-mail address: office@qrtag.pl. In matters related to the processing of personal data, please contact us in writing or by e-mail to the addresses indicated above. The co-administrator of Users’ personal data collected via the Application is also an entity cooperating with the Administrator on the basis of a separate agreement for the creation of the Application (hereinafter: “Business Partner”), who implements its loyalty program towards Users via the Application (hereinafter: “Loyalty Program”) . The business partner’s data is included in the Application. Information related to the implementation of the Loyalty Program and the protection and processing of personal data collected by the Business Partner may be specified independently of this Privacy Policy. The Administrator is not responsible for the activities of the Commercial Partner towards Users related to the protection of their personal data, for the Commercial Partner obtaining the necessary consents from Users related to sending them commercial and marketing information and for the Commercial Partner’s implementation of the provisions of the GDPR and other provisions of generally applicable law by the Commercial Partner. .

§ 3

Data categories

The Administrator and Business Partner process the following data, including Users’ personal data: data used to set up a User account and log in: date and time of User registration, date and time of last login, name and surname, Facebook ID, Apple ID, e-mail address, token (registration and password recovery token), password; firebase Key, UUID, Ad ID, date of registration of the User in the system, type of operating system, type (version and trade name) of the Application; number of points on the account in the Loyalty Program, permanent customer discount, EAN code (User’s card code – a type of internal ID used to identify the User by the Commercial Partner service), full history of operations affecting the account balance (purchases, use of discount codes); the number of points collected / the number of used coupons in the Loyalty Program and the date and time of scanning / collecting / using; commercial benefits (discounts, promotions, rebates, etc.) used by the User and the date, time, location and data of the Commercial Partner who used the benefits; tags (information collected in the form of a survey about the User’s consumer preferences, which are used to send marketing and other information); history of showing (scanning) to the Commercial Partner of the User’s code contained in the Application in order to obtain points in the Loyalty Program; the User’s purchase history (including information from receipts) downloaded from the Merchant’s systems in order to calculate the User’s zero balance in the Loyalty Program; used discounts (the Application stores discount coupons, and then, if they are presented to the Commercial Partner, the system records the date and time of using the discount and the ID of the Commercial Partner’s employee scanning the discount coupon); User’s location data; other data

Terms of use

§ 1

Subject of the Regulations

This document defines the rules of functioning and operation of the Loyalty Application and the conditions for its use, including the rights and obligations of the Users and the Organizer.

§ 2

Definitions

Loyalty application – a program whose rules are specified in these Regulations.

Organizer – DR SOBCZAK DENTAL CLINIC, The Dubai Mall, Dubai, U.A.E.

User – a natural person who has met the conditions described in § 4 sec. 1 of the Regulations and joined the Program.

Points – units of account in the Program awarded on the terms specified in the Regulations.

Balance – Points collected by the User as part of the Loyalty Application, on the terms set out in the Regulations.

Loyalty Card – User’s virtual card with an individual identification number.

Discount coupon – a random number sequence authorizing you to purchase Products on preferential price terms.

Special Promotions – additional promotions or actions organized by the Organizer for Users

Technological Operator – QRTAG sp.z o.o. ul. Głogowska 70/18, 60-740 Poznań, NIP: 7831735647, REGON: 363401597, KRS: 0000595589, District Court, Poznań – Nowe Miasto and Wilda in Poznań, VIII Commercial Division, National Court Register Share capital: PLN 60,700 paid in full.

§ 3

General provisions

On the terms set out below in the Regulations and subject to certain conditions, by joining the Loyalty Application, the User may:

Start collecting Points in the Loyalty Application and exchange the Points for discount coupons available in the application.

Receive other benefits granted by the Organizer, e.g. freebies or discounts.

The loyalty application is run by the Organizer.

The loyalty application is operated by the Operator.

The application is available on mobile phones and other mobile devices with Android or IOS operating systems in the mobile application available in the App Store and Google Play.

The program is designed to reward Users who purchase Products or services at DR SOBCZAK DENTAL CLINIC

The lack of a point of sale on the list in the application means that such point of sale does not participate in the Loyalty Application.

The User’s participation in the Program is free of charge.

Participation in the Program is voluntary, and the User may resign from it at any time.

Joining the Loyalty Application is possible at any time during the Program.

The User is obliged to participate in the Program in a manner consistent with the provisions of applicable law and the provisions of the Regulations.

§ 4

Conditions for joining the Loyalty Application

Users of the Loyalty Application may be natural persons who are consumers within the meaning of the provisions of the Civil Code.

The condition for joining the Loyalty Application is:

application download,

reading and accepting the content of the Regulations,

filling in the Registration Form in a correct and complete manner,

As soon as all the conditions for participation in the Loyalty Application are met, the person joining the Loyalty Application becomes its User.

In order to register, the user must provide an e-mail address or log in via his own Facebook account

The User is required to establish a password to access the Application during registration.

The User may reset his password after selecting the appropriate option in the Application at any time.

The User declares that the personal data provided by him when completing the registration form are true and up-to-date.

Providing personal data when completing the registration form is voluntary, however, it is necessary to participate in the Program.

§ 5

Rules for collecting Points by the User

Points can be collected as part of the Loyalty Application, on the terms specified by the Organizer.

Points collected under a given Balance may not be transferred or used for the benefit of a third party, including another User.

Collecting Points on the terms set out in these Regulations is possible from the moment of registration in the Application.

Points awarded as part of the Loyalty Application will be credited to the User’s individual account.

Points are awarded for purchasing goods at the bar.

The Organizer does not add Points if the subject of the purchase are excluded products.

The current Balance status is displayed on the User’s account in the Application.

Points awarded in the Loyalty Application may only be used in the manner specified in these Regulations.

Calculation of Points as part of the Balance requires the purchase of goods at DR SOBCZAK DENTAL CLINIC, the presentation by the User of the Loyalty Card along with the individual number of the Seller’s Loyalty Card assigned to it.

Points are calculated as follows: for each 1 (say: one) Dirham issued at DR SOBCZAK DENTAL CLINIC on the terms specified in the Regulations, the Balance is increased by 1 (say: one) Point. Points are awarded in proportion to the value of the purchase made.

In the event of a return of goods purchased at the bar, the Points awarded for this purchase will be canceled by the User returning the goods.

Points cannot be exchanged for money or any other means of payment.

The exchange of Points for a rebate coupon will automatically reduce the User’s Balance by the number of Points assigned to the rebate coupon.

§ 6

Additional benefits related to participation in the Loyalty Application

The organizer reserves the right to organize additional promotions.

Participation in additional promotions is voluntary.

As part of the Loyalty Application, the User may be granted other benefits by the Organizer, e.g. freebies, rebates, discounts, vouchers or other special price or product offers.

As part of the Loyalty Application, the Organizer may organize contests with prizes, as well as quizzes and surveys for Users.

Users will be informed about additional promotions via the Application and / or electronically.

Detailed rules for additional promotions will be specified in separate regulations.

§ 7

Termination of the User’s participation in the Loyalty Application

The Organizer reserves the right to terminate the User’s participation in the Program for non-compliance with the provisions of the Regulations.

The termination must be made in writing, indicating the reason for the termination of participation in the Program. The User may lodge an appeal within 14 (say: fourteen) days of receiving the notice of termination, by sending it to the Organiser’s address.

In the event of termination of participation in the Program, all Points will be canceled.

The User may resign from participation in the Program at any time. Information about the resignation should be sent to the e-mail address: twojadres@jakasnazwa.com

The User may uninstall the Application from his device at any time. However, removing the Application does not mean resignation from participation in the Program. Resignation from participation in the Program is possible only after informing the Organizer.

§ 8

Complaints

Complaints regarding the rules and the course of the Program may be submitted to the Organizer via e-mail to the following address: twojadres@jakasnazwa.com Information on considering the complaint will be provided to the User by e-mail within 7 days of submitting the complaint.

§ 9

Personal data

The administrator of personal data is DR SOBCZAK DENTAL CLINIC, The Dubai Mall, Dubai, U.A.E.

Personal data is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC ( General Data Protection Regulation).

The Organizer, under a separate agreement, entrusts the processing of personal data of the Program Users to the technological Operator to the extent necessary to operate the Program by the technological Operator.

§ 10

Amendments to the Regulations

The organizer reserves the right to change the Regulations.

In the event of a change to the Regulations, the Organizer will notify the Users about the changes.

§ 12

Final provisions

The full text of the Regulations is available in the application.

Due to the updates of the Android and iOS operating systems, it may be necessary to update the Application. The Organizer will notify Users about the need to update via the Application.
