BAMINEX SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ SPÓŁKA KOMANDYTOWA (BAMINEX), operating DR SOBCZAK treatment facilities, hereinafter referred to as Clinics, makes every effort to protect the confidentiality and security of your personal data.

This Privacy Policy, hereinafter referred to as the Policy, sets forth the rules for the processing and protection of your personal data collected at BAMINEX in connection with the provision of dental, dental x-ray and outpatient specialized health services. The purpose of the Privacy Policy is to provide owners of personal data processed at BAMINEX with the necessary information on how the data are processed, the rights of data owners and methods of securing personal data.

For the purpose of a better perception of the Privacy Policy, the term “you” may be replaced by “you, you” and the term “Administrator” may be replaced by “we”.

The term “RODO” means Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC.

How do we obtain your data? What data do we process?
We obtain information containing your personal data directly during the first stages of medical services: in-person or electronic registration and on an ongoing basis, during the provision of medical services. BAMINEX processes your personal data of two types:

ordinary data – name, surname, PESEL, age, gender, residential address, telephone, email, data of persons authorized to access information and medical records
data of special categories – medical data, concerning your health, image

BAMINEX pays special attention to the accuracy of your data, so when we collect it, we check its accuracy with the document containing your image, presented by you. Periodically we will ask you to update the data we have. You, too, can update your information at any time. To update your data, please contact the Clinics’ reception desks.

How do we contact you?
Depending on the extent of the contact information you have provided, we may contact you by letter, e-mail, telephone, SMS, via the website.

BAMINEX contact information is available in this document, advertising materials and on the BAMINEX website.

When contacting us, we will ask you to provide information that identifies you personally.

For what purpose do we collect your personal information?
We collect your personal information for the purposes of:

registration for the medical services provided;
Issuing sales documents for medical services;
providing medical services;
maintaining medical records in accordance with legal requirements in this regard;
communicating with you on matters related to the medical services provided.
We also process your personal data for a legitimate purpose of the data controller who is a business enterprise, such as:

sending correspondence;
handling complaints and requests;
security of persons and property;
asserting claims arising from our operations;
fulfilling the obligations imposed on an entrepreneur by legal requirements, such as accounting, invoicing, etc.

What are the legal bases for our processing of your personal data?
Our personal data processing activities are governed by specific laws, mainly:
Act of November 06, 2008 on Patients’ Rights and Patients’ Ombudsman;
RODO – Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016 on the protection of natural persons in relation to the processing of personal data and on the free flow of such data, and repealing Directive 95/46/EC;
The Personal Data Protection Act of 10.05.2018
The Regulation of the Minister of Health of November 08, 2015 on types, scope and models of medical records and the manner of their processing
How long do we keep your data?
We must store your data in accordance with the Act of November 06, 2008 on Patient Rights and Patient Ombudsman, for a period of no less than 20 years and no more than 30 years from the end of the year in which medical services to you were completed.

Your data cannot be deleted before the set period, so you do not have the right provided for in the RODO – the right to request deletion of data or to “be forgotten.” This is a feature of data protection that is specific to the medical industry, which has laws equivalent to the RODO regarding the retention of medical records.

Is it your obligation to provide data ?
The use of our services is entirely voluntary, but the collection of personal data is necessary for the provision of medical services. Provision of personal data listed in Section 3 of the Privacy Policy is a condition for the provision of medical services.

At the stage of on – line registration (online enrollment) we may collect your data to a limited extent – name, surname, email address, telephone number.

The premises of DR SOBCZAK Clinics are covered by video surveillance. You have the right not to consent to monitoring in the office where medical services are provided to you. If you have objections to monitoring in your office, please report them to the front desk staff, who will disable the video recording system in the office for the duration of your visit.

With whom do we share your personal data?
We share your data only with entities entitled to receive them or with entities cooperating with BAMINEX in the course of carrying out the tasks of the treatment facility.

Data is also provided on the basis of a legal obligation or at the legitimate request of an authorized body, such as the Social Security Administration, or to the Court, if, as a result of proceedings, the Court makes such a request to us.

Entities cooperating with BAMINEX in the course of providing health care services are affiliated with BAMINEX by relevant agreements, ensuring the confidentiality of your personal data. Upon your request, the Data Protection Officer will provide you with a list of entities to which your data is transferred.

How do we protect your data?
Protecting and ensuring the confidentiality of your personal data is very important to us.

We have implemented technical, organizational and physical security measures to:

protect your data from loss, unauthorized access or use;
securing information systems and protecting the information collected therein;
to be able to restore the data obtained from you in the event of loss of its integrity or its loss as a result of an emergency situation.
BAMINEX has implemented a personal data security system in compliance with the RODO, which is constantly being improved.

When necessary, we use adequate technical measures for data security, encryption mechanisms for data collected electronically or other measures to protect your data. We periodically review our security procedures to analyze the solutions used and assess the need for modification.

However, we would like to point out that there is no perfect security of personal data that is impossible to break.

Do we intend to transfer your personal data to countries outside the European Economic Area?
We do not intend to transfer your personal data to countries outside the European Economic Area, however, if such transfer is necessary, you will be asked to provide your written consent to such transfer.

Information about automated decision-making, including profiling
We will not make decisions about you in an automated manner, i.e. without human influence. When processing your personal data, we do not use profiling, understood as forecasting your preferences, interests, economic situation, etc.

Monitoring
Video surveillance and recording of telephone calls made by staff are used to ensure the full safety of people in the treatment facility.

Video monitoring covers public rooms and offices. Recordings from video surveillance are kept for a period of no more than 3 months from the moment of recording. Only BAMINEX Management has access to the recordings.

You have the right not to consent to monitoring in an office where medical services are provided to you. If you have objections to monitoring in the office, please report them to the reception staff, who will disable the video recording system in the office for the duration of your visit.

Cookies
For the purpose of contacting you and for the purpose of conducting online patient registration, BAMINEX uses a company website. The website does not automatically collect any information, except for the information contained in so-called “cookies.”

Cookies (so-called “cookies”) are computer data, in particular text files, which are stored on the final device of the person viewing the website and are intended to improve the use of the website. Cookies usually contain the name of the website from which they come, the time they are stored on the end device and a unique number.

Cookies are used for:

adapting the content of the website to the preferences of the person using it and optimizing the use of the site – in particular, these files allow to recognize the computer of the person browsing the website and appropriately display the website, tailored to his/her individual needs;
creating statistics on the use of the website.
BAMINEX uses cookies to create statistics on the use of the website. In the future, we may use cookies to adapt the content of the website to the preferences of the person using it, to optimize the use of the website and for marketing activities.

Two main types of cookies are used when using the website:

“session” (session cookies);
“permanent” (persistent cookies).
“Session” cookies are temporary files that are stored on the end device of the person browsing the website until the person logs out, leaves the website or turns off the software (web browser).

“Permanent” cookies are stored on the end device of the person browsing the website for the time specified in the parameters of the cookies or until they are deleted by the User.

Cookies placed on the end device of the person using the website may also be used in the future by entities cooperating with BAMINEX, performing tasks in the field of sales of medical services or marketing activities.

The person using the website may delete the cookies at any time using the IT tools prepared for this purpose by the suppliers of Internet browsers.

Information about updating the privacy policy
Updating of this policy may take place at any time. If changes are made, information will be posted on the website.

Applicable law
The rules set forth in this policy are governed by Polish law and the laws of the European Union.

What are your privacy rights?
The rights set forth below are related to privacy and concern the processing of your personal data.

We will exercise the following of your rights:

The right to access your Personal Data, including receiving information about the Personal Data we process

You have the right to receive information about your Personal Data processed by us.

Your request for information may include a request to:

to receive confirmation that your data is being processed;
an indication of the scope of the data we process, the duration of its storage;
to indicate the recipients or categories of recipients of the data;
to provide access to your medical records
However, if your request for information on personal data is unfounded or repetitive, we may refuse to provide information.
We will respond to your request as soon as possible, but no later than within 2 weeks of receipt of the request. If it would take longer than 2 weeks to provide the information, we will inform you. In this case, we will respond no later than within three months.

You may request copies of paper and electronic data that we hold, share or use, including data collected in medical records.

In order to process your application, you may need to provide information to confirm your identity. We may only provide you with information pertaining to you. In case your request could lead to violation of another person’s privacy, we may not provide you with such information.

The right to correct and complete data concerning you
If you inform us that the data we have about you is incorrect, we will verify it and, if the request is legitimate, correct the data.
We are obliged to inform the entities to which we have shared your data of the update you have notified us (based on the consent we have obtained from you to do so).

The right to lodge a complaint with a data protection supervisory authority.

In the event that you find that BAMINEX violates data protection laws, you may file a complaint with the supervisory authority, which is the President of the Office for Personal Data Protection.
